They say the White House could decide not to appeal the ruling last month by U.S. District Court Judge Virginia Phillips that declared the policy unconstitutional. If Phillips were to issue an order banning the Pentagon from enforcing the “don’t ask” policy — and the Justice Department decided not to appeal — it could effectively end the 17-year-old policy.
Another option: Obama could issue an order suspending military discharges under DADT or direct the Pentagon to draft new regulations that would sharply limit the the ability to bring cases for discharge.
